Terms of Service: Communication & Payments
Welcome to Healthy Studs Marketplace. To maintain a safe and professional environment for all our users, please adhere to the following terms regarding communication and payments.
1. Introduction and Platform Role
[Your Site Name] acts as a neutral marketplace connecting stud owners (“Vendors”) with animal owners (“Seekers”). We do not own, inspect, house, or provide veterinary services for any animals listed. By using this platform, you acknowledge that any breeding agreement is a private contract solely between the Vendor and the Seeker.
2. Secure Communication Policy
To ensure the safety of our community and the validity of our Service Guarantees, all communications must take place through the [Your Site Name] Message Center.
-
Bypass Prohibition: Sharing direct contact information (phone numbers, email addresses, social media handles) or soliciting “off-site” payments (Cash, Venmo, etc.) before a booking is confirmed is strictly prohibited.
-
Consequences: Accounts found attempting to bypass the secure system may be permanently suspended, and [Your Site Name] will not provide dispute resolution for off-site arrangements.
3. Health and Genetic Disclosures
Vendors are required to provide accurate and verified health clearances (e.g., OFA, PennHIP, or DNA panels).
-
Accuracy: Misrepresentation of an animal’s health, pedigree, or fertility is grounds for immediate account termination.
-
Vetting: While we provide “Verified” badges for certain listings, it is the Seeker’s ultimate responsibility to perform due diligence before proceeding with a breeding.
4. Booking and “No-Pregnancy” Policy
A “Booking” on [Your Site Name] constitutes a payment for the provision of the stud service, not a guarantee of a successful litter.
-
Biological Risk: Breeding is unpredictable. Refund or “return service” policies regarding “misses” (failure to conceive) are determined by the individual Vendor and must be clearly stated on the specific Stud Profile.
5. Limitation of Liability
[Your Site Name] is not liable for any injury, illness, or death of any animal, nor any financial loss resulting from a breeding transaction. Our maximum liability for any claim related to the use of the platform is limited to the amount of the commission fee paid to [Your Site Name] for the specific transaction in question.
6. Animal Welfare Compliance
All users must adhere to the Animal Welfare Act and local state breeding laws. We reserve the right to report suspected inhumane treatment or “puppy mill” operations to the appropriate authorities.
